Please read these Terms of Use ("Terms") carefully before accessing or using the services provided by Credbuddha Financial Consultancy Services Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at [Building No./Flat No.: 50-90-25/GF-1, Road/Street: main road, Santhi Puram, Visakhapatnam, Andhra Pradesh - 530016]. ("CREDBUDDHA", "Company", "we", "our" or "us").
These Terms govern your access to and use of the CREDBUDDHA website, mobile interface, application journey, APIs, communications and related services (collectively, the "Platform") and the services made available through the Platform from time to time as more particularly described herein (collectively, the "Services"). By accessing, browsing, registering on, or otherwise using the Platform, you ("User", "you" or "your") acknowledge that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy, Disclaimer and any other policies, guidelines, notices or terms made available on the Platform from time to time, all of which are deemed to form an agreement.
If you do not agree with these Terms or any part thereof, you must immediately discontinue access to and use of the Platform and/or Services.
The Company reserves the right to amend, modify, update or replace these Terms at any time, in its sole discretion, including to reflect changes in applicable law, regulatory requirements, business practices, technology or the functionality of the Platform and Services. Any such modification shall become effective upon publication on the Platform, unless otherwise stated. Your continued access to or use of the Platform or Services following such publication shall constitute your acceptance of the revised Terms. You are encouraged to review these Terms periodically to remain informed of any updates.
These Terms constitute an electronic record within the meaning of the Information Technology Act, 2000 and the rules made thereunder and do not require any physical or digital signature.
PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE PLATFORM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE BOUND BY THESE TERMS. THESE TERMS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND CREDBUDDHA GOVERNING YOUR ACCESS TO AND USE OF THE PLATFORM AND THE SERVICES MADE AVAILABLE THROUGH IT.
In these Terms, unless the context otherwise requires, the following expressions shall have the meanings assigned to them below:

| KFS | The Key Fact Statement issued by the relevant Lender containing material loan terms, charges, fees, Annual Percentage Rate (APR), repayment obligations and such other disclosures as may be required under Applicable Law. |
| Lender / RE | A Regulated Entity, including a bank, non-banking financial company or other financial institution authorised under Applicable Law to offer loan products and responsible for credit assessment, lending decisions, disbursement, servicing and recovery activities. |
| LSP | A Lending Service Provider engaged by a Lender under a written arrangement to perform such functions as may be permitted under Applicable Law in connection with digital lending activities. |
| Partner Institution | Any Lender, Account Aggregator, Credit Information Company, payment service provider, financial institution or other third-party service provider engaged by or associated with CREDBUDDHA for the provision of Services. |
| Personal Data | Any information relating to an identified or identifiable individual, including information provided, uploaded, generated, collected or processed through the Platform. |
| Platform | The CREDBUDDHA website, mobile interface, application journey, APIs, communications channels and other digital infrastructure through which the Services are made available. |
| Services | The services made available through the Platform from time to time as more particularly described in these Terms. |
| Terms | These Terms of Use, together with the Privacy Policy, Disclaimer and other documents incorporated herein by reference. |
| Applicable Law | All applicable laws, statutes, rules, regulations, directions, circulars, notifications, guidelines and governmental or regulatory requirements in force from time to time in India. |
2.1 By accessing or using the Platform or Services, You represent, warrant and undertake that:
2.2 Certain Services or loan products made available through the Platform may be subject to additional eligibility criteria prescribed by the relevant Lender or Partner Institution. Satisfaction of the eligibility requirements set out herein shall not guarantee approval of any loan application, credit facility or financial product.
2.3 CREDBUDDHA reserves the right to deny, restrict, suspend or terminate access to the Platform or Services if it reasonably believes that You do not satisfy the eligibility requirements set out in these Terms or have provided false, inaccurate, incomplete or misleading information.
2.4 If at any time You cease to satisfy any of the eligibility requirements specified herein, You shall immediately discontinue use of the Platform and Services and notify CREDBUDDHA of the same.
3.1 In order to access certain features of the Platform or avail certain Services, You may be required to create and maintain an account with CREDBUDDHA. During the registration process, You may be required to provide certain information and documents, including Your name, mobile number, email address, identification details, financial information and such other information as may be required by CREDBUDDHA, the relevant Lender or any Partner Institution from time to time.
3.2 By creating an account and using the Platform, You represent and warrant that all information and documents furnished by You are true, accurate, complete and current. You further undertake to promptly update any information that becomes inaccurate, incomplete or outdated.
3.3 You acknowledge and agree that CREDBUDDHA, the relevant Lender and/or Partner Institutions may rely upon the information and documents provided by You for the purposes of onboarding, verification, regulatory compliance, credit assessment, fraud prevention and provision of the Services.
3.4 CREDBUDDHA reserves the right to verify the information and documents provided by You through lawful means and may require additional information, documentation, declarations or consents at any time for the purpose of providing the Services or complying with Applicable Law.
3.5 You are solely responsible for maintaining the confidentiality and security of Your account credentials, passwords, one-time passwords (OTPs) and other authentication mechanisms associated with Your account. You shall take all reasonable precautions to prevent unauthorised access to or use of Your account.
3.6 You shall immediately notify CREDBUDDHA upon becoming aware of any actual or suspected unauthorised access to, use of, or compromise of Your account or credentials. CREDBUDDHA shall not be liable for any loss arising from Your failure to maintain the security of Your account credentials.
3.7 Your account is personal to You and may not be assigned, transferred, shared, sublicensed or otherwise made available to any third party without the prior written consent of CREDBUDDHA.
3.8 If CREDBUDDHA reasonably believes that any information provided by You is false, inaccurate, incomplete, misleading or incapable of verification, CREDBUDDHA may, without prejudice to any other rights or remedies available under Applicable Law, suspend, restrict or terminate Your account and access to the Platform or Services.
3.9 If You fail to notify CREDBUDDHA of any changes to the information previously provided by You, CREDBUDDHA shall be entitled to rely upon the information available in its records for the provision of the Services.
3.10 Any breach of these Terms, misuse of the Platform, fraudulent activity, unauthorised access, or violation of Applicable Law may result in suspension or termination of Your account and access to the Platform, in addition to such civil, criminal or regulatory remedies as may be available to CREDBUDDHA.
4.1 CREDBUDDHA operates and manages the Platform through which Users/You may access information relating to loan products and other financial products or services offered by Lenders and Partner Institutions.
4.2 The Services provided through the Platform may include, without limitation:
4.3 CREDBUDDHA acts as a technology platform and/or Lending Service Provider and facilitates interactions between Users and Lenders or Partner Institutions. CREDBUDDHA is not a bank, non-banking financial company or other regulated lending institution and does not itself provide loans unless expressly stated otherwise.
4.4 CREDBUDDHA does not undertake any lending activity and does not make decisions regarding a User's creditworthiness, eligibility, approval, rejection, sanction, pricing, tenure, disbursal, servicing, restructuring or recovery of any loan or financial product. Such decisions are made solely by the relevant Lender in accordance with its internal policies and Applicable Law.
4.5 The availability of any loan product, financial product or service on the Platform shall not constitute a recommendation, endorsement, guarantee or assurance by CREDBUDDHA regarding the suitability, approval or performance of such product or service.
4.6 CREDBUDDHA does not guarantee that any application submitted through the Platform will be approved by a Lender/Partner Institution or that any particular terms, rates, amounts or benefits will be offered to a User.
4.7 Submission of an application through the Platform does not create any obligation on the part of CREDBUDDHA or any Lender to process, approve or sanction a loan. Any application may be accepted, rejected or returned for additional information at the sole discretion of the relevant Lender and in accordance with Applicable Law.
4.8 Any loan or financial product availed by a User shall be governed by the applicable Key Fact Statement (KFS), sanction terms, loan agreement, privacy notice and other documents issued by the relevant Lender or Partner Institution. The relationship between the User and the relevant Lender or Partner Institution shall be governed exclusively by such documents.
4.9 CREDBUDDHA may engage third-party service providers, technology partners, Account Aggregators, credit information companies, verification agencies and other Partner Institutions in connection with the provision of the Services. You acknowledge and agree that certain aspects of the Services may be dependent upon such third-party services.
4.10 CREDBUDDHA reserves the right to modify, suspend, discontinue or introduce any Service or feature on the Platform at any time, subject to Applicable Law.
4.11 CREDBUDDHA acts as a Lending Service Provider to one or more Lenders and performs only such activities as may be contractually delegated by the relevant Lender and permitted under Applicable Law. The identity of the relevant Lender shall be disclosed to the User before submission of any loan application.
5.1 Where the Platform supports multiple Lenders, CREDBUDDHA may provide a digital comparison of available loan offers and shall display the identity of participating Lenders whose products are relevant to a User's request.
5.2 The Platform may apply matching criteria based on information provided by the User, lender eligibility requirements, product suitability parameters and other relevant factors in order to identify and display potentially suitable loan products and offers. Such matching is intended solely to facilitate comparison and shall not be construed as a recommendation, endorsement or guarantee of any lender or loan product.
5.3 Where applicable, the Platform may display the following information relating to a lender offer:
5.4 Where multiple lender offers are available, the Platform may display available offers in a manner designed to facilitate comparison by the User. The User shall have the ability to review material terms of the available offers before proceeding with a lender of choice. Where the Platform ranks, sorts, filters or prioritises lender offers, the basis of such ranking, sorting, filtering or prioritisation shall be clearly disclosed through the Platform. Unless expressly stated otherwise, any ranking, sorting or display order shall be for informational and user-convenience purposes only and shall not be construed as indicating preference, recommendation, endorsement, superiority, suitability or likelihood of approval by CREDBUDDHA.
5.5 CREDBUDDHA shall not employ deceptive user interface practices, misleading design features, dark patterns or any other mechanism intended to unfairly influence, manipulate or impair a User's ability to make an informed decision regarding a lender, loan product or financial service. Users shall be provided with sufficient information to compare available offers and make an informed choice.
5.6 CREDBUDDHA shall endeavour to apply a fair, objective and consistently applied matching methodology for similarly situated borrowers and comparable products. The display of an offer on the Platform shall not create any obligation on the part of the relevant Lender to approve or disburse a loan.
5.7 Submission of an application through the Platform does not create any obligation on the part of CREDBUDDHA or any Lender to process, approve, sanction or disburse a loan. Any application may be accepted, rejected, withdrawn or returned for additional information at the sole discretion of the relevant Lender and in accordance with Applicable Law.
6.1 Prior to the execution of any loan transaction, the relevant Lender shall provide or make available to the User the applicable Key Fact Statement (KFS), sanction terms, loan agreement, privacy disclosures and such other documents, disclosures and notices as may be required under Applicable Law.
6.2 The User acknowledges that the KFS shall contain the material terms of the proposed loan, including the loan amount, tenure, Annual Percentage Rate (APR), interest rate, fees, charges, repayment obligations, cooling-off period and such other information as may be prescribed by the Reserve Bank of India or other applicable regulatory authorities. Users are advised to carefully review the KFS and all loan-related documents before accepting any offer or executing any loan transaction.
6.3 No loan shall be deemed to have been accepted solely by reason of registration on the Platform, submission of an application or provision of information by the User. A loan transaction shall be concluded only upon completion of the applicable acceptance process prescribed by the relevant Lender.
6.4 The Platform may facilitate electronic execution of application forms, declarations, consents, loan documentation and other records through electronic means permitted under Applicable Law. The User acknowledges that electronic records, electronic signatures, electronic consents, OTP-based authentication and other electronic acceptance mechanisms may constitute valid and binding acceptance of the relevant documents in accordance with Applicable Law.
6.5 Copies of executed loan documents, the KFS and related communications may be delivered by the relevant Lender through the User's registered email address, mobile number, customer dashboard, SMS link or such other communication channel as may be permitted under Applicable Law.
6.6 The contractual relationship governing any loan shall exist solely between the User and the relevant Lender and shall be governed by the applicable loan documents. CREDBUDDHA is not a party to the loan agreement and does not assume any obligations of the Lender except to the extent specifically required under Applicable Law or under its role as a Lending Service Provider.
6.7 The User acknowledges and agrees that the relevant Lender shall be solely responsible for loan approval, sanction, disbursal, servicing, repayment administration, customer grievance handling relating to the loan, credit reporting, recovery activities and compliance with applicable regulatory requirements governing the loan.
6.8 Where the Platform facilitates the collection, transmission or processing of information, documents, consents or instructions relating to a loan application, CREDBUDDHA shall process such information in accordance with the Privacy Policy, applicable contractual arrangements and Applicable Law. Personal Data shall be collected, processed, stored, shared and retained only for lawful purposes and to the extent necessary for providing the Services, complying with legal obligations or fulfilling obligations owed to the User or the relevant Lender.
6.9 The User acknowledges that CREDBUDDHA may maintain records relating to applications, consents, authorisations, communications and transaction journeys for purposes including regulatory compliance, audit requirements, fraud prevention, dispute resolution, security and operational purposes, in accordance with Applicable Law and the Privacy Policy.
6.10 Any dispute relating to loan terms, sanction conditions, interest, fees, repayment obligations, account statements, credit bureau reporting, recovery actions or lender-specific obligations shall be addressed primarily through the grievance redressal mechanism of the relevant Lender.
7.1 CREDBUDDHA does not charge or collect from Users/You any fee, charge, commission, facilitation fee, service fee or other consideration that is payable by a Lender to CREDBUDDHA in connection with the Services or digital lending activities, unless expressly disclosed to the User and permitted under Applicable Law.
7.2 All interest rates, Annual Percentage Rates (APR), processing fees, foreclosure charges, prepayment charges, penal charges, default charges and other loan-related costs shall be determined and disclosed by the relevant Lender through the KFS and applicable loan documentation prior to acceptance of the loan by the User.
7.3 The User acknowledges that acceptance of a loan offer shall constitute acceptance of the fees, charges and repayment obligations disclosed by the relevant Lender in the KFS and loan documentation.
7.4 CREDBUDDHA does not receive or collect loan repayments from Users on behalf of Lenders unless expressly authorised under Applicable Law and disclosed to the User.
7.5 Users shall not make any payment relating to a loan application or loan transaction to any individual, employee, representative, agent or account that is not expressly authorised by the relevant Lender.
7.6 Any request for payment, deposit, transfer or consideration outside authorised channels shall be immediately reported through the grievance redressal mechanism made available on the Platform.
8.1 In accordance with Applicable Law, loan disbursals shall be made directly by the relevant Lender to the bank account of the User, except where disbursal to a third party is expressly permitted under Applicable Law and authorised by the User.
8.2 Loan repayments shall be made directly by the User to the relevant Lender through the repayment mechanisms specified by the Lender and in accordance with the applicable loan documentation.
8.3 CREDBUDDHA shall not operate, maintain or utilise any pass-through account, pool account or intermediary account for routing of loan disbursals or repayments, except where expressly permitted under Applicable Law.
8.4 All servicing, administration and management of the loan account, including repayment schedules, account statements, credit reporting, restructuring requests and customer support relating to the loan, shall remain the responsibility of the relevant Lender.
8.5 Any recovery activity relating to a loan shall be undertaken solely by or on behalf of the relevant Lender in accordance with Applicable Law, applicable regulatory requirements and the policies of the relevant Lender.
8.6 Where a Lender appoints a recovery agent or other authorised representative, the Lender shall remain responsible for the acts and omissions of such persons and for ensuring compliance with Applicable Law and applicable regulatory requirements.
8.7 CREDBUDDHA does not authorise, endorse or permit any form of harassment, coercion, intimidation, public shaming, misleading representation, invasion of privacy or other unlawful recovery practice.
8.8 Any dispute relating to loan approval, disbursal, repayment, interest, charges, account statements, credit bureau reporting, recovery actions or other lender-specific obligations shall primarily be addressed through the grievance redressal mechanism of the relevant Lender.
9.1 Where applicable under the policies of the relevant Lender and Applicable Law, the User may be entitled to a cooling-off or look-up period following disbursal of a digital loan.
9.2 The duration, conditions and process applicable to the cooling-off period shall be specified by the relevant Lender in the KFS and applicable loan documentation.
9.3 During the applicable cooling-off period, the User may exercise the option provided by the relevant Lender to exit the loan by repaying the principal amount and the proportionate APR accrued for the period during which the loan remained outstanding, together with such charges as may be expressly permitted under Applicable Law and disclosed in the KFS.
9.4 No foreclosure charge, penalty or other charge shall be imposed during the cooling-off period except as expressly permitted under Applicable Law and disclosed by the relevant Lender in the KFS.
9.5 Registration on the Platform, creation of an account, submission of an application, provision of information or commencement of an application journey shall not, by itself, create any obligation on the User to accept a loan product or on any Lender to approve or provide a loan.
9.6 The User may discontinue or abandon an application at any time prior to acceptance of a loan offer, subject to any requirements imposed by Applicable Law or the relevant Lender.
10.1 By accessing or using the Platform and Services, You expressly consent to receive communications from CREDBUDDHA, Lenders, Partner Institutions and authorised service providers through telephone calls, SMS, email, WhatsApp, in-app notifications, push notifications, customer dashboards and such other electronic communication channels as may be provided or authorised by You from time to time.
10.2 Such communications may relate to customer onboarding, identity verification, KYC, application processing, credit assessment, lender matching, loan offers, transaction confirmations, loan servicing, repayment reminders, customer support, grievance handling, fraud prevention, security alerts, regulatory disclosures, service updates and other matters connected with the Services.
10.3 You acknowledge and agree that all notices, disclosures, records, agreements, Key Fact Statements (KFS), statements, consents, authorisations and other communications transmitted electronically shall constitute valid electronic records and communications under Applicable Law and shall satisfy any legal requirement that such communications be made in writing.
10.4 CREDBUDDHA may record, monitor, retain and review telephone calls, chats, emails, messages and other communications with Users for quality assurance, training, customer support, fraud prevention, dispute resolution, audit, security and regulatory compliance purposes.
10.5 By using the Platform, You authorise CREDBUDDHA to collect, receive, process, analyse, store, use, disclose, transfer and otherwise deal with information and Personal Data provided by You or generated through Your use of the Platform for purposes including customer onboarding, verification, lender matching, application processing, credit assessment facilitation, fraud prevention, customer support, analytics, security, regulatory compliance and such other lawful purposes as are disclosed in these Terms, the Privacy Policy or otherwise communicated to You.
10.6 You authorise CREDBUDDHA to share Your information, documents, application details and other relevant data with Lenders, Partner Institutions, Credit Information Companies, Account Aggregators, verification agencies, technology service providers, payment service providers, analytics providers, cloud service providers, professional advisors, regulatory authorities and other authorised third parties to the extent necessary for providing the Services, complying with Applicable Law or fulfilling the purposes for which such information was collected.
10.7 Where required under Applicable Law, consent for the collection, processing, use or sharing of Personal Data shall be obtained through clear, specific and affirmative action and shall be appropriately recorded through audit trails, logs or other evidentiary records maintained by CREDBUDDHA.
10.8 You acknowledge that certain Services may require additional consents, declarations or authorisations, including for identity verification, KYC verification, credit bureau enquiries, Account Aggregator-based data sharing, bank account verification, fraud prevention checks or other regulatory processes. Such consents shall be obtained separately wherever required under Applicable Law.
10.9 You acknowledge and agree that consents, authorisations and instructions provided through click-wrap acceptance, check-box confirmations, OTP authentication, electronic signatures, biometric authentication, consent artefacts or other legally recognised electronic acceptance mechanisms shall constitute valid and binding consent to the extent recognised under Applicable Law.
10.10 Subject to Applicable Law, You may withdraw or manage consent for consent-based processing through the mechanisms described in the Privacy Policy or otherwise made available through the Platform. Withdrawal of consent shall not affect the lawfulness of processing undertaken prior to such withdrawal and may affect the availability of certain Services.
10.11 Notwithstanding withdrawal of consent, CREDBUDDHA may continue to retain, process, use or disclose information where required for compliance with Applicable Law, regulatory directions, contractual obligations, fraud prevention, security purposes, audit requirements, dispute resolution, record retention obligations or administration of an existing loan or transaction.
10.12 Transactional, regulatory and service-related communications shall continue to be provided where necessary for the provision of Services or compliance with Applicable Law. Promotional and marketing communications shall be provided in accordance with the User's communication preferences and Applicable Law.
11.1 CREDBUDDHA is committed to protecting the privacy and security of User information and shall process Personal Data in accordance with Applicable Law and the Privacy Policy made available on the Platform.
11.2 The Privacy Policy forms an integral part of these Terms and should be read together with these Terms. By accessing or using the Platform, You acknowledge that You have read, understood and agreed to the Privacy Policy.
11.3 CREDBUDDHA shall collect, process, use, store, disclose, transfer, retain, archive, anonymise or delete Personal Data only for lawful purposes connected with the provision of the Services, compliance with Applicable Law, fulfilment of contractual obligations, fraud prevention, security, dispute resolution and other purposes disclosed in the Privacy Policy.
11.4 Personal Data may be shared with Lenders, Partner Institutions, Credit Information Companies, Account Aggregators, verification agencies, technology service providers, payment service providers, professional advisors, regulatory authorities and other authorised entities to the extent permitted under Applicable Law and necessary for the provision of the Services.
11.5 The Platform may utilise cookies, software development kits (SDKs), pixels, tags, device identifiers, log files and similar technologies for authentication, security, fraud prevention, analytics, performance monitoring, personalisation, service improvement and user experience enhancement. Further information regarding such technologies is set out in the Privacy Policy and any applicable cookie notice.
11.6 CREDBUDDHA shall endeavour to collect and process only such Personal Data as is reasonably necessary for the provision of the Services and the purposes disclosed to the User.
11.7 Where necessary for customer onboarding, identity verification, KYC compliance, fraud prevention, geolocation verification, video verification, document capture or customer support, the Platform may request limited access to device features such as the camera, microphone, location services or document storage. Such access shall be requested only for the specific purpose disclosed to the User and shall remain subject to the User's explicit consent. Except as expressly permitted under Applicable Law or required for a Service specifically requested by the User, CREDBUDDHA shall not access or collect contact lists, call logs, SMS messages, telephony data, photo galleries, video files or other device-stored personal content for digital lending purposes.
11.8 Users may exercise such rights in relation to their Personal Data as may be available under Applicable Law and the Privacy Policy, subject to applicable legal, regulatory and contractual requirements.
12.1 The User acknowledges and agrees that, in connection with the provision of the Services, evaluation of eligibility, facilitation of loan applications, fraud prevention, risk assessment, account review, portfolio monitoring, customer servicing and other lawful purposes, CREDBUDDHA, the relevant Lender and/or Partner Institutions may obtain, access, retrieve, receive, review, use and process information relating to the User from Credit Information Companies, Account Aggregators, financial information providers, verification agencies and other authorised sources in accordance with Applicable Law.
12.2 The User expressly authorises CREDBUDDHA to facilitate the submission of requests for credit information, credit reports and related information to Credit Information Companies on behalf of the relevant Lender or Partner Institution, where such facilitation is necessary for the provision of the Services.
12.3 The User acknowledges and understands that enquiries made with Credit Information Companies may be recorded by such entities and may be visible to other authorised users of credit information in accordance with Applicable Law.
12.4 The User further authorises CREDBUDDHA, the relevant Lender and Partner Institutions to share information, documents, application details, repayment information and other relevant data with Credit Information Companies for purposes including credit assessment, credit reporting, fraud prevention, portfolio monitoring, customer servicing, regulatory compliance and other lawful purposes permitted under Applicable Law.
12.5 Where the Services involve the sharing, retrieval or processing of financial information through the Account Aggregator ecosystem, such activity shall be governed by the consent artefact generated under the applicable Account Aggregator framework, Applicable Law and the policies of the relevant Account Aggregator.
12.6 Financial information accessed through the Account Aggregator ecosystem shall be collected, processed, used, shared, stored and retained only for the purposes authorised by the User through the applicable consent artefact and as otherwise permitted under Applicable Law.
12.7 The User acknowledges that any consent artefact generated through the Account Aggregator ecosystem may specify the nature of financial information to be shared, the purpose of access, the entities authorised to access such information, the frequency of access and the duration of such consent.
12.8 CREDBUDDHA shall not access, retrieve or process financial information through the Account Aggregator ecosystem except pursuant to a valid consent artefact or as otherwise permitted under Applicable Law.
12.9 The User may withdraw or modify consent granted through the Account Aggregator ecosystem in accordance with the applicable Account Aggregator framework and Applicable Law. The User acknowledges that withdrawal of consent may affect the ability of CREDBUDDHA, the relevant Lender or Partner Institution to provide certain Services, process applications, verify information or assess eligibility for financial products.
12.10 The User acknowledges and agrees that financial information obtained through the Account Aggregator ecosystem may be shared with the relevant Lender, Partner Institution and authorised service providers solely for the purposes authorised by the User and in accordance with Applicable Law.
12.11 CREDBUDDHA shall implement reasonable administrative, technical and organisational safeguards designed to protect credit information, financial information and Personal Data processed pursuant to this Clause and shall process such information in accordance with Applicable Law, these Terms and the Privacy Policy.
12.12 CREDBUDDHA does not determine, control or guarantee any credit score, credit assessment, credit decision, credit report or lending decision generated by a Credit Information Company, Account Aggregator, Lender or Partner Institution.
12.13 Where required under Applicable Law, separate and specific consent for obtaining, accessing, processing or sharing credit information or financial information may be sought through the Platform, and the User agrees that such consent may be provided through click-wrap acceptance, OTP authentication, electronic signatures, consent artefacts or other legally recognised electronic means.
13.1 The User shall use the Platform and Services only for lawful purposes and in accordance with these Terms and Applicable Law. The User represents, warrants and undertakes that all information, documents, declarations, consents and instructions provided through the Platform shall be true, accurate, complete and not misleading.
13.2 The User shall not:
13.3 The User shall cooperate with CREDBUDDHA, Lenders and Partner Institutions in connection with any verification, compliance review, fraud investigation, dispute resolution process or regulatory requirement relating to the Services.
13.4 Any violation of this Clause may result in suspension or termination of access to the Platform and such other action as may be available under Applicable Law.
14.1 The Platform, Services and all content made available through them, including software, source code, text, graphics, images, logos, trademarks, service marks, trade names, designs, layouts, databases, compilations, audiovisual content, interfaces and other proprietary materials ("Content"), are owned by or licensed to CREDBUDDHA and are protected under Applicable Law relating to intellectual property rights.
14.2 Subject to these Terms, CREDBUDDHA grants the User a limited, non-exclusive, non-transferable, revocable and non-sublicensable licence to access and use the Platform solely for personal and lawful purposes in connection with the Services.
14.3 Except as expressly permitted under these Terms, the User shall not:

15.1 The Platform may contain links to, integrate with, provide access to or otherwise facilitate interactions with third-party websites, applications, platforms, products or services, including those of Lenders, Partner Institutions, Account Aggregators, Credit Information Companies, payment service providers, verification agencies and other service providers.
15.2 Certain Services made available through the Platform may be provided, operated or supported by third parties. The availability of such services through the Platform shall not constitute an endorsement, recommendation or warranty by CREDBUDDHA regarding such third party or its products or services. CREDBUDDHA does not control and shall not be responsible for the availability, accuracy, legality, security, content, performance or practices of any third-party website, application, platform, product or service.
15.3 The User acknowledges and agrees that access to and use of third-party products or services may be subject to separate terms and conditions, privacy policies and contractual arrangements prescribed by the relevant third party, and the User shall be solely responsible for reviewing and complying with such terms.
15.4 Any transactions, dealings, communications or arrangements between the User and a third party, including any Lender or Partner Institution, shall be solely between the User and such third party unless expressly stated otherwise.
15.5 CREDBUDDHA shall not be liable for any loss, damage, delay, deficiency, interruption or claim arising out of or relating to any act, omission, product, service or conduct of a third party, except to the extent such liability cannot be excluded under Applicable Law.
16.1 The Platform and Services are provided on an "as is", "as available" and "with all faults" basis.
16.2 To the maximum extent permitted under Applicable Law, CREDBUDDHA does not make any representation, warranty or guarantee, express or implied, regarding:
16.3 Information, content, comparisons, calculators, eligibility indicators, illustrative offers and other materials made available through the Platform are provided for informational purposes only and shall not constitute financial, legal, tax, investment or professional advice.
16.4 Any eligibility indication, pre-qualified amount, loan comparison, recommendation engine output or indicative offer displayed through the Platform shall not constitute a sanction, commitment or guarantee by CREDBUDDHA or any Lender.
16.5 CREDBUDDHA does not guarantee that a User will qualify for any loan or financial product or that any application submitted through the Platform will be approved by a Lender.
16.6 The User acknowledges that lending decisions, underwriting outcomes, pricing, loan terms, disbursals and servicing are determined solely by the relevant Lender.
16.7 Nothing contained in these Terms shall exclude or restrict any rights that cannot lawfully be excluded under Applicable Law.
17.1 To the fullest extent permitted under Applicable Law, CREDBUDDHA, its affiliates, directors, officers, employees, representatives, licensors and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, loss of business, loss of goodwill, loss of opportunity, loss of data or business interruption, arising out of or relating to:
17.2 To the extent permitted under Applicable Law, CREDBUDDHA's aggregate liability arising out of or relating to these Terms, the Platform or Services shall not exceed the amount of fees, if any, actually paid by the User to CREDBUDDHA for the specific Service giving rise to the claim during the twelve (12) months preceding the event giving rise to such claim.
17.3 Nothing in these Terms shall limit or exclude liability where such limitation or exclusion is prohibited under Applicable Law.
18.1 The User agrees to indemnify, defend and hold harmless CREDBUDDHA, its affiliates, directors, officers, employees, representatives, agents, licensors, service providers, Lenders and Partner Institutions from and against any and all losses, liabilities, claims, demands, actions, proceedings, damages, penalties, costs and expenses (including reasonable legal fees and expenses) arising out of or in connection with:
18.2 The obligations under this Clause shall survive termination of these Terms and the User's access to the Platform.
19.1 CREDBUDDHA may, at its sole discretion and without prejudice to any other rights or remedies available under Applicable Law, suspend, restrict, disable or terminate a User's access to the Platform or Services, with or without prior notice, if:
19.2 Termination or suspension of access shall not affect any rights, obligations, liabilities or remedies accrued prior to such termination or suspension.
19.3 CREDBUDDHA may retain information and records following suspension or termination to the extent required under Applicable Law, regulatory requirements, audit obligations, fraud prevention requirements or legitimate business purposes.
19.4 The User may discontinue use of the Platform at any time. However, termination of access to the Platform shall not affect any obligations arising under any loan agreement or other arrangement entered into between the User and a Lender or Partner Institution.
20.1 CREDBUDDHA has established a grievance redressal mechanism to address complaints, concerns and grievances relating to the Platform and Services. CREDBUDDHA shall prominently display on the Platform the details of its Grievance Officer, customer support contact details and escalation mechanism in accordance with Applicable Law.
20.2 Any grievance relating to the Platform, Services, privacy matters, consent management, communications or conduct of CREDBUDDHA may be submitted through the contact details provided on the Platform.
20.3 The details of the Grievance Officer, including name, designation, contact details and response timelines, shall be made available on the Platform in accordance with Applicable Law.
20.4 CREDBUDDHA shall endeavour to acknowledge and address grievances within the timelines prescribed under Applicable Law.
20.5 Any grievance relating to loan approval, sanction, disbursal, repayment, interest, charges, credit bureau reporting or recovery actions shall primarily be addressed through the grievance redressal mechanism of the relevant Lender.
21.1 These Terms shall be governed by and construed in accordance with the laws of India.
21.2 Any dispute, claim, or controversy arising out of or relating to these Terms, the use of the Platform, or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Visakhapatnam, Andhra Pradesh, India.
22.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent court, such provision shall be modified to the minimum extent necessary to make it enforceable.
22.2 The remaining provisions of these Terms shall continue in full force and effect.
23.1 Failure by CREDBUDDHA to enforce any provision of these Terms shall not constitute a waiver of that provision or of the right to enforce it at a later time.
23.2 Any waiver shall be effective only if made in writing.
24.1 These Terms, together with the Privacy Policy, Disclaimer and other documents incorporated herein by reference, constitute the complete and exclusive agreement between You and CREDBUDDHA regarding the use of the Platform and Services.
24.2 They supersede all prior communications, understandings, or agreements, whether oral or written.
